Eligibility
The 12 Days of LiftMas Giveaway (the “Promotion”) is open only to legal residents of the United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. The Promotion is subject to all applicable federal, state and local laws and is void outside the United State and the District of Columbia and where prohibited by law. By participating in this Promotion, participant(s) who enter this Promotion (“Entrant(s)”) agree to abide by and be bound by these terms and conditions and decisions of Carol Cole Company, a California corporation (“NuFACE”), which shall be final in all matters relating to the Promotion.
Promotion Period
The Promotion begins at 12:00 a.m. Pacific Time on December 12, 2022 and ends at 11:59 p.m. Pacific Time on January 23, 2023 (the "Promotion Period").
How to Enter
To receive an entry, Entrant will need to have their own individual Instagram account. If Entrant does not already have an Instagram account and wishes to enter, Entrant must create an account. To receive an entry for each individual day, Entrant must complete the following steps: (1) Follow @mynuface on Instagram, (2) like NuFACE’s post of the day for such day, (3) comment on NuFACE’s post of the day, tagging a friend, for such day. You will receive one (1) entry into that day’s promotion for completing steps 1, 2, and 3. All entries for days 1-11 will also be entered for the 12th day Grand Prize. All entries must comply with all further requirements and content restrictions set forth in these terms and conditions. LIMIT ONE (1) ENTRY PER PERSON AND/OR INSTAGRAM ACCOUNT PER DAY. Content of the comments on NuFACE’s posts of the day will not affect eligibility. All entries must follow the submission requirements set forth below and comply in all respects with these terms and conditions. All entries may be posted on NuFACE’s websites and/or social media accounts. All entries are subject to a review by NuFACE prior to posting online.
Prizes, Approximate Retail Value (“ARV”) & Odds of Winning:
One (1) grand prize (“Grand Prize”): one (1) four (4) day, three (3) night stay at the House of NuFACE, located in San Diego County, California (the “House of NuFACE”) between the dates January 7, 2023 and March 31, 2023, for up to four (4) people, including the winner (ARV $1,500.00), Five Hundred and 00/100 Dollar ($500.00) in virtual gift cards for local restaurants as allowance for meals (ARV $500.00) and two (2) free professional facial treatments provided by NuFACE. Total ARV of the Grand Prize is $2,500.00. The winner of the Grand Prize (“Winner”) must provide their own transportation at Winner’s expense. NuFACE is not responsible if flights are cancelled/delayed leading them to missing the scheduled stay at the House of NuFACE. LIMIT ONE (1) PRIZE PER PERSON. Odds of winning a prize depend on the number of eligible entries received.

Prize(s) must be accepted as awarded. All characteristics and features of the prize(s) except as otherwise explicitly stated above are at the NuFACE’s sole and absolute discretion. No substitution, cash redemption, sale or transfer of prize(s) is permitted except at NuFACE’s sole discretion or as provided herein. If a prize, or any portion thereof, cannot be awarded for any reason, NuFACE reserves the right to substitute such prize (or portion thereof) with an equivalent prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the prize(s), are the sole responsibility of the applicable winner(s). Arrangements for delivery of prize(s) will be made after winner validation.
Prize Drawing
On December 13, 2022, the NuFACE will conduct a random drawing for the day 1 prize from among all eligible entries received on day 1 of the Promotion Period.
On December 14, 2022, the NuFACE will conduct a random drawing for the day 2 prize from among all eligible entries received on day 2 of the Promotion Period.
On December 15, 2022, the NuFACE will conduct a random drawing for the day 3 prize from among all eligible entries received on day 3 of the Promotion Period.
On December 16, 2022, the NuFACE will conduct a random drawing for the day 4 prize from among all eligible entries received on day 4 of the Promotion Period.
On December 17, 2022, the NuFACE will conduct a random drawing for the day 5 prize from among all eligible entries received on day 5 of the Promotion Period.
On December 18, 2022, the NuFACE will conduct a random drawing for the day 6 prize from among all eligible entries received on day 6 of the Promotion Period.
On December 19, 2022, the NuFACE will conduct a random drawing for the day 7 prize from among all eligible entries received on day 7 of the Promotion Period.
On December 20, 2022, the NuFACE will conduct a random drawing for the day 8 prize from among all eligible entries received on day 8 of the Promotion Period.
On December 21, 2022, the NuFACE will conduct a random drawing for the day 9 prize from among all eligible entries received on day 9 of the Promotion Period.
On December 22, 2022, the NuFACE will conduct a random drawing for the day 10 prize from among all eligible entries received on day 10 of the Promotion Period.
On December 23, 2022, the NuFACE will conduct a random drawing for the day 11 prize from among all eligible entries received on day 11 of the Promotion Period.
On December 24, 2023, the NuFACE will conduct a random drawing for the Grand Prize from among all eligible entries received during the entire Promotion Period.
Prizes, excluding the Grand Prize will be shipped no later than approximately January, 24, 2023.
Notification & Validation of Winners
Potential winners will each be contacted by NuFACE, at its election by mail, courier service, telephone or email. Entrants may be required to complete, sign and return an affidavit or declaration of eligibility, a liability release, tax forms, and where lawful, a publicity release within a stated amount of time. The return of any notification as undeliverable or failure to respond to notices or return any required documents or information in a timely manner or a determination that a potential winner is ineligible or not in compliance with these terms and conditions, as determined by the NuFACE, in its sole discretion, may result in disqualification of the winner and forfeiture of the corresponding prize, and the choosing of an alternate winner in a random drawing from among the remaining eligible entries.
Winner Announcement:
The winner(s) of this promotion will be published on NuFACE’s Instagram page on or around January 24, 2022.
Limitations
To the fullest extent permitted by applicable law, NuFACE is not responsible for: (i) Entries that are late, incomplete, misdirected, or not received by NuFACE for any reason; (ii) any problems or technical malfunctions, errors, delays, communication, (iii) damage to Entrants' or any person's computer; (iv) causes beyond NuFACE’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion; (v) incorrect or inaccurate entry information whether caused by Entrants or Instagram; (vi) any typographical or other error in the advertising related to the Promotion, in the administration or execution of the Promotion, or in the announcement/notification of prize winners; (vii) any human, or other error, which may occur in the promotion or administration of this Promotion; or (viii) cheating or fraud by any participant.
Disqualification
Entries which are incomplete, incorrect, incomprehensible, not received, or do not otherwise comply with these terms and conditions (as determined by NuFACE in its sole and absolute discretion) will be void and will not be entered into the Promotion's prize drawing. Entries made any manner not specifically allowed under these terms and conditions will not be entered into the Promotion. NuFACE reserves the right, in its sole discretion, to disqualify any individual who tampers with or attempts to tamper with the entry process or who acts in a disruptive or unfair manner.
Modification, Suspension and Termination
If for any reason the Promotion cannot be executed as planned NuFACE reserves the right, in its sole discretion, to void suspect entries/Entrants and/or modify, suspend and/or terminate this Promotion. If the Promotion is terminated before the stated end date of the Promotion Period, NuFACE may select the winners in a random drawing from among all applicable eligible, non-suspect entries received as of the time and date of termination. Thereafter, NuFACE reserves the right to accept no further entries and award no further prizes
Cancellation
If for any reason Winner cancels their stay at House of NuFACE, Winner shall receive no reimbursement for lost prizes. NuFACE may, in NuFACE’s sole discretion, reschedule Winner’s stay at House of NuFACE, at Winners sole cost and expense.
Pets
Winner is not allowed to have or keep any pets, even temporarily, on any part of the House of NuFACE. The unauthorized presence of any pet will subject Winner to penalties and damages. Properly trained service animals that provide assistance to individuals with disabilities may be permitted in House of NuFACE with the prior written consent of NuFACE, which shall not be unreasonably withheld. Winner will be responsible for the costs of defleaing, deodorizing and/or shampooing all or any portion of House of NuFACE if a pet has been in or at House of NuFACE at any time during their stay at House of NuFACE (whether with or without written consent of House of NuFACE).
Releases
By participating in this Promotion, Entrants agree to the maximum extent permitted by law, that: (i) all claims arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) to release, defend, indemnify and hold harmless NuFACE and its successors and assigns from and against any and all liability, losses, claims or causes of action, including, but not limited to, bodily injury, death or damages arising out of Entrant’s participation in this Promotion or the acceptance, possession, use or misuse of any prize received in this Promotion; and (iii) neither NuFACE nor any of its agents, contractors or employees, shall be liable to Entrant or any person claiming through Entrant for any exemplary, special, incidental or consequential damages, attorneys’ fees, court costs, or any damages other than actual out-of-pocket costs incurred to enter, and any and all rights to have damages multiplied or otherwise increased or any cause whatsoever, including, without limitation, claims caused by or resulting from the negligence, gross negligence or willful misconduct of NuFACE or its agents, contractors or employees.
Publicity
Except where prohibited, participation in the Promotion constitutes each Entrant’s permission for NuFACE to use Entrants' names, photographs, videos, voices and any other likenesses for purposes of advertising and publicity in all media now known or hereinafter invented without territorial or time limitations and without compensation or notice.
Privacy
By entering this Promotion, each Entrant agrees that NuFACE, its agents and representatives may store, share and use the personal information Entrant submitted with their entry for the purpose of administering the Promotion and agrees to the collection, use and disclosure of their personal information as described in these terms and conditions, as permitted by law.
Choice of Law; Venue.
The provisions of these terms and conditions shall be construed and interpreted in accordance with the laws of the State of California, and venue for any action brought with respect to any claims arising out of these terms and conditions or the Promotion shall be brought exclusively in San Diego County, California.
Severability
If any provision of these terms and conditions is invalid, illegal, or unenforceable, the balance of these terms and conditions shall remain in effect, and if any provision is inapplicable to any person or circumstance, it shall nevertheless remain applicable to all other persons and circumstances.
Third Party Rights
Manufacturers of the prizes offered in this Promotion do not sponsor or endorse this Promotion and are not affiliated with the NuFACE in any way. This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. Entrants are providing their information to NuFACE and not to Instagram.
Assumption of Risk
Entrant hereby agrees that NuFACE will be liable to Entrant for any loss, illness or injury (including but not limited to COVID-19 and other known or unknown coronaviruses) befallen on any persons in attendance during or in connection with the stay at or travel to or from House of NuFACE, and Entrant expressly assumes all risk of and waives any and all claims it may have against NuFACE for loss, illness or injury.
Disclaimer
Subject to applicable laws, NuFACE makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the competition. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUBJECT TO APPLICABLE LAWS, PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
