Non-affiliated third parties are independent from NuFACE, and if you wish to receive information about your disclosure choices or stop communications from such third parties, you will need to contact those non-affiliated third parties directly.

Notice of Financial Incentive
In connection with the loyalty programs, we may offer financial incentives and/or price or service differences (“Incentives”) to participants in exchange for our use of your personally identifiable information.

To offer these Incentives, we must track the personally identifiable information you provide when you sign up or engage in activities in connection with loyalty programs or similar programs, such as your email address, referral activity, purchase history, and engagement with NuFACE (“Program Data”), as described in the loyalty program or similar programs.

The value of the Program Data is calculated by determining the approximate additional spending per participant, per year compared to individuals who have not participated in loyalty programs or similar programs.   • Right to Appeal. If we deny your request, the right to appeal our decision. The easiest way to submit a request to appeal is to follow the instructions in our response denying your request. You may also call us at (888) 360-9171. We will respond to appeals from Virginia and Connecticut residents within sixty (60) days. We will respond to appeals from Colorado residents within 45 days.

When you exercise these rights and submit a request to us, we will verify your identity by asking you to log in to your account if you have one with us. Or if you do not, we may ask for your email address, order numbers of previous orders, or other information we think would allow us to verify your request. NuFACE may also use a third-party verification provider to verify your identity. We will endeavor to honor such requests unless such a request conflicts with certain lawful exemptions under your state’s consumer privacy law.

The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of our goods or services.

Outside the United States

For residents of the European Union (and United Kingdom), NuFACE is the data controller responsible for your personally identifiable information collected pursuant to this Privacy Policy. Our digital operations are conducted, in whole or in part, in the United States. Regardless of where you live, you consent to have your personally identifiable information transferred to, processed and stored in the United States, and allow NuFACE to use and collect your personally identifiable information in accordance with this Privacy Policy.

In addition, residents of certain countries, including European Union member states (and the United Kingdom), have some or all of the following rights with respect to personally identifiable information collected from and about you and the right to request access to, and correct, delete, and/or restrict processing of personally identifiable information. In some instances (i) the right to object to the processing of such personally identifiable information (ii) the right to request that NuFACE export, in a structured, commonly used, and machine-readable format, and transmit to another controller, such personally identifiable information; and (iii) the right to withdraw, at any time, your consent to the processing of such personally identifiable information. Opt Out Provisions and Customer Choices

We currently offer the following choices and options regarding how your personally identifiable information is used and shared.:

  • Viewing or Updating your Personally Identifiable Information. If you have registered for an account, you have the ability to review, change and/or correct the personally identifiable information you provide to us by going to the web page that links to your account and using the edit tools provided there to change your information. You can also contact our customer service department via email at info@nuface.com to access or update any of this information.

Residents of California, Colorado, Connecticut, Utah, and Virginia, as well as certain other countries, including European Union member states (and the United Kingdom), may have additional rights listed under " State Specific Privacy Information" and "Outside the United States".

  • Targeted advertising. You may opt out of the use of information about your browsing activities on our services to show you ads on other websites and services by adjusting your settings for each device and browser you use with the Website and App. To opt out of targeted advertising, you must submit a request using our [https://www.mynuface.com/pages/ccpa-compliance] and adjust settings for each device and browser you use with the Website and the App. Alternatively, you may visit our services using a legally recognized device or browser-based universal opt out mechanism such as the Global Privacy Control, which will opt out the sharing of your personally identifiable information at a browser level. You may also opt out of targeted advertising by certain companies that participate in third-party industry groups by visiting the Network Advertising Initiative consumer opt out page or the Digital Advertising Alliance's consumer choice tool. In addition, your device settings may offer you additional privacy settings when using the App; please see the device settings for details. Please note that even if you opt out of receiving interest-based advertising, you will still receive advertisements, but they will be more general in nature.
  • Email. To opt out of or unsubscribe from our newsletter, click on the “Unsubscribe” link in the e-mail you have received, or go to your account page on the website. After logging in, you will be taken directly to a page that will allow you to unsubscribe to future emails. Please uncheck the box that indicates “Subscribe to Email”. Then click submit. Please allow 24 hours for your request to be processed. Should you wish to be added again in the future, just do a basic registration the next time you visit www.mynuface.com. To do this, simply click on the “Newsletter Sign-Up” button on the home page and fill in your name and e-mail address. This will add you, once again, to the mailing list.
  • Direct mail. You may opt out of receiving marketing or advertising by direct mail by logging into your account on the website and indicating your preference. Alternatively, you can contact us through one of the methods specified in the “Contact Us” section below and provide the name and mailing address that you would like to opt out. Please note that these requests may take up to 8-10 weeks to become effective.
  • Telephone (calls and texts). You may opt out of receiving text messages by texting "Stop" at the end of any message you receive, or to opt out of marketing or advertising calls, by contacting us through one of the methods specified in the “Contact Us” section below and sharing the telephone number that you would like to opt out.
  • Push Notifications. When you use app, you may receive push notifications. If you prefer not to receive push notifications, you may adjust your settings on your device to control whether you want to receive these alerts.
  • App Geolocation Information. When you use apps on your device, you may choose not to share your geolocation information with us by adjusting the device’s location service settings.

Additional rights in Specific Jurisdictions. For our customers residing in California, Colorado, Connecticut or Virginia, state law grants you additional rights (see above for information on the rights currently granted by state). Completing the form online will allow us to begin working on your request more quickly and efficiently, but we recognize that some customers may have difficulty using the online form or would prefer support from our team to complete it; you can get help by calling (888) 360-9171. NuFACE will not discriminate or retaliate against you if you elect to exercise any legally available rights as described in this Privacy Policy. If you would like an authorized agent to submit a request on your behalf, please send us an email at info@nuface.com for instructions and additional information we need to respond to a request when submitted by a legally authorized agent.

Identity Verification Requirement. If you make a request for specific pieces, categories, or deletion of personally identifiable information we will ask you to provide the following: full name, order number, physical address, email address, and telephone number, so that we may verify your identity.

If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial.

Changes to our Privacy Policy

As we strive to improve our products and services, we may revise our Privacy Policy from time to time. We encourage you to periodically consult this Privacy Policy. If there are updates, they will be posted to this Privacy Policy page on our website along with the effective date of the revision.
